The Landlord Changed the Locks or Cut Off the Electricity: Is Evicting a Tenant Legal in Israel?

Even proven rent arrears do not allow the apartment owner to change the locks, disconnect the electricity, or put the tenant’s belongings outside. A court judgment is required first, and if the tenant does not comply voluntarily, the procedure must be carried out through the Enforcement and Collection Authority.

Numbers and facts
  • 30 days — the exception for responding to unlawful seizure, not an ordinary tenancy
  • 30 days — the period until the hearing after the final deadline for filing the final statement of defense
  • 17 years — the tenant in the case considered had lived in the apartment
  • ₪70,000 — awarded by the court to the unlawfully evicted tenant
  • ₪100,000 — the original amount of his claim

Debt Does Not Turn a Tenant Into a Trespasser

The Land Law, 1969 protects not only the owner but also a person who actually possesses real estate. Section 18 permits the use of reasonable force against unlawful seizure within 30 days, but this is a narrow exception not intended for evicting a tenant who originally moved in under a lease. Therefore, arrears, the expiration of the lease, or a material breach of the agreement must first be assessed by a court. Even a clause written into the agreement granting the owner the right to change the locks or remove belongings independently may be declared invalid as contrary to public policy.

What Constitutes an Unlawful Eviction

Typical prohibited actions include changing the lock, blocking the entrance, disconnecting electricity or water, removing belongings, and forcibly entering the apartment. The owner does not automatically acquire such a right, even if rent is unpaid, checks are returned, or the lease term has already ended. After an eviction judgment, the owner is also not entitled to personally put the tenant out: actual enforcement is carried out through the Enforcement and Collection Authority. Self-help may expose the owner to a civil claim and, in cases involving threats or physical pressure, additional legal consequences.

The Price of a Single Lock Change: The 70,000-Shekel Case

In Vladimir Tkhorev v. Michael Fligelman, the Tel Aviv–Jaffa Magistrate’s Court considered the eviction of a tenant who had lived in the apartment for 17 years. After the locks were changed, his belongings, clothing, and medications remained inside, while he lived on the street for several months. The court stated that even assuming a material breach of the agreement and the expiration of the lease term, eviction without a court order was unlawful. Of the claimed 100,000 shekels, the court awarded the tenant 70,000 shekels for pecuniary and non-pecuniary damage.

What a Tenant Should Do Immediately After a Disconnection or Lock Change

The first useful step is to document what is happening: photograph the lock or disconnected appliances, retain the owner’s messages, and record the date access was lost. The tenant should demand in writing that access or the utility service be restored and retain the agreement, proof of payments, and documents concerning belongings left inside. The tenant should not break down the door or engage in a physical confrontation: this complicates the dispute and creates new risks. If medications, documents, or essential items are inside, this should be stated explicitly in the written request and when seeking urgent professional assistance.

How the Expedited Eviction Claim Proceeds

The lawful route for an owner is a claim for eviction from leased premises under Rule 81 of the Civil Procedure Regulations. This route focuses on recovering the apartment, so the monetary debt is usually considered separately; the defendant may not file a counterclaim or a third-party notice within such a proceeding, and no preliminary hearing is held. The court examines the agreement, the lease term and the conditions for its termination, evidence of arrears, correspondence, notices, and the tenant’s objections—for example, claims of serious defects in the apartment. The hearing must take place within 30 days after the final deadline for filing the final statement of defense. If the judgment is not complied with voluntarily, the owner submits it for enforcement rather than arranging the eviction independently.

FAQ

Can the lock be changed if the tenant has not paid for months?

No. Nonpayment may be grounds for terminating the agreement and filing an eviction claim, but it does not confer the right to block access to the apartment independently. A court judgment and, if necessary, its enforcement by the authorized authority are required.

Is a contract clause allowing the electricity to be disconnected or belongings to be removed valid?

Case law does not recognize contractual permission for forcible self-help as sufficient grounds. Provisions permitting eviction without a court may be deemed contrary to law and public policy.

Can the police evict a tenant at the owner’s request?

An ordinary dispute over a tenancy and arrears is treated as a civil matter and referred to court. Forced eviction requires a court document, which is then enforced through the Enforcement and Collection Authority.

Can eviction and the entire monetary debt be claimed at the same time?

The expedited route is intended primarily to vacate the property. Claims for rent arrears, damage, and other amounts may be filed separately so that the monetary dispute does not delay resolution of the issue concerning the apartment.

What does the court examine in an eviction case?

The court examines the agreement, its term, the termination procedure, evidence of the breach, and the parties’ correspondence. It also assesses the tenant’s objections, including claims that the apartment is defective or that proper notice was not given.

What to do next

After a lock change or utility disconnection, the tenant should immediately gather evidence and demand in writing that the previous situation be restored. If there are arrears or a refusal to vacate the apartment, the owner should document the breach and use the expedited judicial route without resorting to pressure. The specific actions and urgency of the procedure depend on the agreement and the circumstances of the case, so the materials are best shown to a relevant specialist in advance.
