No Written Employment Terms Were Provided: Who Must Prove the Salary Amount in Israel?
An oral agreement on salary does not disappear merely because the employer failed to put it in writing. However, a breach of the duty to provide written employment terms can significantly change the dispute: on several issues, the employer will be required to prove its version.
- •30 days — deadline for providing notice to an adult employee
- •7 days — deadline for an employee under 18
- •15,000 ₪ — base compensation limit without proof of loss
- •15 hours per week — limit for shifting the burden of proof regarding overtime
- •60 hours per month — alternative monthly limit
The Document Must Be Provided at the Start of Employment
Under the Notice to Employee and Job Candidate Law (Employment Terms), 2002, an employer must provide written notice no later than 30 days after employment begins. An employee under 18 must receive it no later than 7 days after employment begins. A separate notice is not required if a written employment contract already contains all the mandatory information. When employment terms change, a new document must generally be provided within 30 days from the date the employer became aware of the change, or within 7 days for a minor.
What Must Be in Writing
The notice must identify the employer and employee and state the employment start date, the term of the contract or its indefinite nature, the main position, and the employee’s direct supervisor. It must separately specify the total amount of payments constituting the salary, payment dates, the length of the regular workday or workweek, and the weekly rest day. It must also describe social contributions and the organizations to which they are actually transferred. A typical mistake is to provide a sheet listing the job title and monthly amount without specifying the pay structure, hours, payment dates, or pension contributions.
How the Absence of a Document Changes a Salary Dispute
If a dispute concerns a mandatory item in the notice, and the document was not provided at all or did not include that specific item, the burden of proof shifts to the employer. For this to apply, the employee must present their version in testimony, including in a written affidavit. For example, if an employee claims that a particular base salary was promised, while the employer states a lower amount and does not produce a proper notice, the employer must prove its version. This does not mean that the employee automatically wins: the Regional Labor Court will still assess correspondence, transfers, payslips, time records, and the parties’ testimony.
The Employment Terms Document, Payslip, and Time Records Are Not the Same Thing
The notice describes the agreed terms, whereas a payslip shows amounts accrued for a specific period. If the dispute concerns overtime and the employer does not produce the required working-time records, the Wage Protection Law, 1958 places the burden of proof on the employer for up to 15 overtime hours per week or up to 60 hours per month. The absence of a payslip, or of the required components in it, also creates separate evidentiary consequences for claims concerning overtime, work during weekly rest, vacation pay, convalescence pay, and transportation payments. Therefore, it is a mistake for an employee to discard messages and bank statements on the assumption that the absence of a contract alone will be sufficient.
Compensation and How to File a Complaint
The Regional Labor Court may award compensation even without proof of monetary loss and order the employer to remedy the violation. If a notice or notice of a change in employment terms was knowingly not provided, compensation without proof of loss may be available: the statutory base upper limit is 15,000 shekels, adjusted annually, and the court may set a different amount for special reasons. Such compensation is not awarded automatically and does not replace a claim for unpaid salary. A suspected violation may be reported to the Labor Laws Regulation and Enforcement Administration at report.achifa@labor.gov.il, by fax at 03-6828690, or by phone at *2570; a complaint may be anonymous. A civil monetary dispute is heard by the Regional Labor Court.
FAQ
If there is no written contract, does that mean there is no employment relationship either?
No. A written employment contract may replace the notice, but the absence of both documents does not by itself negate the work actually performed or the obligation to pay salary. The actual relationship, payments, correspondence, schedules, and other evidence are relevant.
Can 15,000 shekels be claimed solely because no notice was provided?
A claim may be made, but the amount is not awarded automatically. The court examines whether the violation was knowing, considers the circumstances, and applies the statutory indexed limit; for special reasons, it may set a different amount.
What should I do if the notice states a salary lower than what was promised?
You should retain the job advertisement, messages, emails, bank transfers, payslips, and working-time records. In a dispute, the court will compare the written notice with other evidence and the payments actually made.
Does a complaint to the Ministry of Labor replace a salary claim?
A complaint initiates the government enforcement mechanism and may be filed anonymously. A claim for recovery of salary and civil compensation is heard by the Regional Labor Court.
What to do next
Check whether you received a notice or contract containing all mandatory information, and request any missing document in writing. Retain correspondence about salary, payslips, bank statements, and your own time records. If there are discrepancies, you may separately consider an administrative complaint and the procedure for bringing a monetary claim.
