The Payslip Shows Pension Deductions, but the Fund Is Empty: Who Will Repay the Contributions and Losses?

A pension deduction line on a payslip does not yet prove that the money reached the fund. If the employer deducted your share but did not transfer it together with the employer’s share, the claim is usually directed at the employer—and the dispute may concern not only the contributions, but also proven damage to pension rights.

After receiving confirmation of the debt, ask the fund in writing whether the account is considered active, which months are missing, and whether insurance coverage has been affected. At the same time, request the available ways to preserve coverage until the debt is resolved and the exact deadline for taking action—these terms depend on the specific product and the fund’s rules. A self-funded payment should not be regarded as an automatic substitute for the employer’s debt: it is important first to obtain a written calculation from the fund and retain the receipts.

What Evidence Determines the Dispute

Collect the employment contract, all disputed payslips, bank statements, the fund’s month-by-month reports, and correspondence with the accounting department. The court or supervisory authority will compare what was deducted, what the employer was required to add, when the money was actually deposited, and what damage resulted from the delay. In the official administrative case, the specific amounts in the payslips, the date of the late transfer, the employer’s explanation, and the corrective measures taken were examined. If a loss of returns, an insurance payment, or a tax benefit is claimed, documents from the fund and a calculation of causation will be required, not merely the fact that a contribution was missed.

A Complaint to the State and Monetary Recovery Are Not the Same Thing

Failure to transfer deductions is regarded as one of the most serious violations of labor rights and may result in administrative or criminal proceedings. In 2018, the Labor Laws Regulation and Enforcement Administration imposed 351 financial sanctions totaling approximately 42.55 million shekels for failure to transfer deductions and filed 7 indictments under the Wage Protection Law. However, a state fine does not by itself deposit the missing pension money into the employee’s personal account.
