Family Dispute Deteriorated into Murder

According to the amended indictment, a dispute broke out among the relatives in August 2023 over the use of a parking space near their homes in Jerusalem's Anata neighborhood. During the confrontation, Shahada stabbed Mustafa at least 14 times in different parts of his body. The victim collapsed and died from his wounds.

The Deceased's Brother Was Also Injured

Shahada also stabbed Mustafa's brother, who tried to help him. The brother was seriously wounded and required surgery. As part of a plea bargain, Shahada was convicted not only of murder but also of causing injury under aggravated circumstances to the deceased's brother.

The Court's Findings and the Prosecution's Position

The court determined that Shahada was the first to resort to physical violence. The court viewed the repeated stabbing of Mustafa, followed by the attack on his brother, as an expression of cruelty and aggression; the claim of self-defense was rejected. The court also noted that the defendant accepted responsibility only with reservations.

The Sentence Imposed

The Jerusalem District Attorney's Office requested a 25-year prison sentence and an additional penalty, emphasizing the duration of the attack and the possibility of stopping the escalation. The court imposed an 18-year custodial sentence and ordered Shahada to pay compensation of NIS 215,000. The cases of the other individuals involved, who were minors at the time of the incident, were heard separately.

What this means for you

The case illustrates that a family or domestic dispute may lead to separate criminal liability for harm caused to each victim. In determining the sentence, the court considers the number and nature of the blows, the possibility of stopping the violence, the consequences for the victims, the acceptance of responsibility, and the presence or absence of self-defense.
