Three Rulings on Eviction, a Premarital Apartment, and a Fine for Failure to Comply With an Order
Israeli courts considered three disputes concerning housing and the enforcement of judicial decisions. A woman was ordered to vacate state-owned land near Metzitzim Beach without being provided alternative housing, a wife's claim to half of an apartment her husband purchased before their marriage was dismissed, and a construction company was fined NIS 4,000 for each day of delay in commencing the work.

Eviction From Land Near Metzitzim Beach
The Tel Aviv District Court dismissed the appeal of a woman who has lived for decades in a structure near Metzitzim Beach. The land belongs to the state, and the right of possession is held by the Tel Aviv Municipality, which announced its expropriation for public purposes. Judges Idit Barkovitz, Yona Atadgi, and Tal Levy-Michaeli ruled that the authorities' prolonged failure to take action does not in itself indicate an implied license to use public land.
Why Alternative Housing Will Not Be Provided
The woman claimed that she and her husband purchased the lot in the 1960s, but the courts found no evidence of a lawful right to the land. The demand for alternative housing was denied: the Planning and Building Law conditions such a guarantee in cases of expropriation on the resident having a legal or equitable right, and no such right was proven in relation to the applicant. Separate compensation claims filed by the woman are still being adjudicated, so the eviction was not conditioned on advance payment; it was set for December 31, 2026.
Claim to Rights in the Husband's Premarital Apartment
The Jerusalem Family Court dismissed a woman's claim seeking recognition of her right to half of an apartment that her husband purchased for NIS 1.15 million several months before the wedding. Although the mortgage and renovation loan were paid from a joint account, Judge Moshe Brown found no evidence that the husband intended to make the apartment joint property. Under the Spouses (Property Relations) Law, an asset owned by one spouse before the marriage is excluded from the balancing of resources unless a substantial additional factor indicating an intention to share is proven.
Daily Fine Over a Dangerous Building
The Tel Aviv District Court imposed measures under the Contempt of Court Ordinance against Gaon Construction and Investments Ltd., which failed to repair defects in the exterior cladding of a dangerous building on Anne Frank Street in Bat Yam. Judge Yaakov Shaked ordered work to begin within 14 days and to proceed continuously, except on Saturdays and holidays. For each day on which the work does not commence, the company must pay the state NIS 4,000; the company announced that it intends to seek a stay of execution and appeal the decision to the Supreme Court.
What this means for you
Long-term residence on public land and the authorities' failure to take action do not necessarily confer a right of use or a right to alternative housing. Mortgage payments from a joint family account may also be insufficient on their own to obtain a share in an apartment purchased by one spouse before the marriage. Failure to comply with a judicial decision may result in a daily fine until the order is actually carried out.
