Attachment of a Joint Account Due to a Spouse’s Debt: How to Recover Your Share of the Funds

If the debt belongs to one spouse, the bank may still freeze funds in the joint account—up to the amount of the debt. Generally, the other account holder must prove which portion of the funds belongs to them and why collection should not apply to it.

Numbers and facts
  • •50%—the customary initial share of each account holder
  • •10 days—the deadline for the third party’s response to the order
  • •One year—the period of the creditor’s inactivity before a special notice
  • •30 days—the additional period given to the creditor after the notice
  • •90 days—protection of the work grant after its deposit

Why the Bank Also Blocks Your Funds

An attachment of a joint account may be imposed by a court or an Execution Office Registrar. Upon receiving the order, the bank acts as a third party: it must freeze the available funds up to the specified amount and is not required to determine on its own which spouse earned each shekel. If the balance is lower than the attachment amount, the entire balance may become unavailable. Therefore, the statement “this is not my debt” does not, by itself, require the bank to release the funds.

Half Is the Starting Point, but Not an Automatic Outcome

For a joint account, the starting point is generally the presumption that the account holders have equal shares—50% each. The spouse who is not the debtor may request the release of their half, but doing so requires a proactive application accompanied by supporting documents. If the actual division is different, it is possible to try to prove entitlement to a larger share and even to certain funds in full. The account terms and signing arrangements are also important: whether each account holder was authorized to use the funds independently or whether a joint instruction was required is examined separately.

Whom to Contact After the Attachment

First, ask the bank for a copy of the order or its details: the case number, the body that imposed the attachment, the attachment amount and the date it was received. If the attachment was imposed in Execution Office proceedings, the application to release the funds belonging to you must be submitted to the Registrar at the office where the case is being handled. If the order was issued by a court, the question of modifying or canceling it is considered within the appropriate legal proceeding. You may also contact the bank, but the bank is generally not authorized to remove the attachment without a new decision from the competent body.

What Proves Who Owns the Funds

The application should include account statements from the period preceding the attachment, income documents and supporting records for specific transfers. The court or Registrar examines not only the name of the payment recipient but also the movement of the funds: where they came from, whether they were commingled with joint receipts and how the spouses used the account. For example, a consistent match between a salary transfer and employer documents helps trace the source of the funds, but depositing a salary into a joint account does not guarantee automatic release. A prenuptial agreement or another document concerning separation of property may support the claim, but it is examined together with the parties’ actual financial conduct.

Which Mistakes Weaken the Position

It is risky to rely on a conversation with a bank clerk and wait for the bank to separate the other spouse’s funds on its own. Do not submit only a current statement: without a transaction history, it is difficult to determine who owned the balance on the attachment date. A hasty transfer of assets or a fictitious separation of accounts after the debts arose may be perceived as an attempt to conceal property from the creditor. It is also important not to conflate two different claims: “the funds do not belong to the debtor” and “the debtor’s funds are protected by law from collection” require different evidence.

Funds That May Qualify for Separate Protection

In Execution Office proceedings, certain payments are protected regardless of the question of the spouses’ respective shares. The “Kol Zchut” website lists, among other things, maintenance under a judgment or an approved agreement, the protected portion of wages and certain types of payments. A work grant transferred by the Israel Tax Authority is generally protected in the bank account for 90 days, although there is an exception concerning the collection of maintenance debt. Certain payments to families of hostages and missing persons are protected for 30 days, and specified payments from the period following October 7, 2023—subject to the prescribed conditions—for up to 90 days.

FAQ

Can the bank attach the other spouse’s entire salary?

Depositing a salary into a joint account does not automatically exclude it from the attachment. To release the funds, it will be necessary to show the source of the payment and the non-debtor spouse’s entitlement to the corresponding amount; separately, the rules concerning the protected portion of wages may apply.

Must the bank leave me half of the balance?

Not necessarily automatically. The bank implements the attachment order, and the request to release the customary 50% share must be submitted to the body administering the collection, together with evidence.

Can I prove that more than half belongs to me?

Yes. The presumption of equal shares is a starting point, not a final calculation. The sources of the receipts, account statements, income documents, agreements between the spouses and the actual use of the account may be relevant.

Will a prenuptial agreement help remove the attachment?

It may serve as important evidence of separation of property, but it does not guarantee automatic release. It is also examined whether the actual movement of funds was consistent with the agreement and whether the separation was created solely to evade collection.

What will happen if the creditor does not realize the attachment for a long time?

If the creditor has not taken steps to realize the attachment of the bank account for one year, the Enforcement and Collection Authority must require the creditor to act within 30 days. If the inactivity continues, the attachment is canceled.

What to do next

Obtain the order details and complete account statements from the bank, and then classify the disputed balance according to the sources of the receipts. The documents must be submitted to the body that imposed the attachment, without relying on the bank to determine your share on its own. Before transferring funds or separating accounts, it is important to check whether the action could appear to be concealment of property.
