Labor Ministry Proposed Postponing Some Construction Industry Safety Requirements by One Year

Israel’s Labor Ministry is considering postponing until October 16, 2027, the implementation of one of the requirements in the new construction industry safety regulations. This concerns contracts signed before October 16, 2025; the other principal obligations remain in effect.

Key facts

  • •Proposed postponement date — until October 16, 2027
  • •The requirement concerns resources for the safety plan
  • •The relief — for contracts signed before October 16, 2025
  • •The appointment of a safety supervisor is not postponed
  • •The safety plan remains mandatory
  • •The draft was published for public comment

What the Ministry Proposed

In a draft enforcement policy published for public comment, the Labor Ministry proposes temporarily refraining from enforcing the requirement to specify, in the contract between the party commissioning the construction work and the contractor, the resources for implementing the safety plan. These may include protective equipment, fencing, and safety personnel. At this stage, this is a draft and not a final decision.

Conditions for the Postponement

The relief is proposed only for contracts signed before October 16, 2025, and is subject to compliance with documentation requirements. At sites where a safety management plan is required, the responsible party must define the resources in writing, inform the workers that they may review the decision, and record the details in the general log. If a safety organization plan is required, the resources must be detailed in it and the document must be made available for workers’ review.

Which Obligations Remain in Effect

The draft does not establish a general postponement of the new regulations. The obligations to appoint a safety supervisor and ensure that a safety plan is in place continue to apply. The proposed postponement does not apply to contracts signed on or after October 16, 2025.

Reasons and Criticism

The initiative followed an appeal by the Israel Builders Association, which cited a shortage of online forms, unclear requirements, and difficulties in training and recruiting experts. Representatives of the legal sector criticized the manner and timing of the relief’s introduction, and the Kav LaOved organization warned that the postponement could weaken worker protections. According to the organization’s data, 31 workers have already been killed in the construction industry in 2026.

What this means for you

Developers and contractors operating under older contracts may receive additional time to arrange the allocation of safety resources, but only subject to written documentation and making the information accessible to workers. For workers, this does not cancel the applicable requirements concerning a supervisor and a safety plan. Because only a draft has been published, the final rules may still change.
